1. Agreement & Eligibility

By accessing or using iCreateAds, you agree to these Terms. You must be at least 18 and able to form a binding contract.

2. Accounts & Security

Authentication is via Azure Entra ID. You’re responsible for your credentials and all activity under your account. Notify us promptly of unauthorized use.

3. Payments, Fees & Taxes

Payments are processed by Stripe. You authorize charges and agree to Stripe’s Terms and Privacy Policy. Fees are due at order unless otherwise specified. Prices exclude taxes unless stated; you are responsible for all applicable taxes. Chargebacks may result in suspension and collection of amounts due plus costs.

4. User Content & Ownership of Notices/Ads

You retain ownership of the original content you submit. However, by submitting any ad, legal notice, obituary, classified, or related content, you grant iCreateAds and the publishing newspaper a perpetual, irrevocable, worldwide, royalty-free license to publish, republish, display, archive, adapt, distribute, and otherwise use such content in any format or medium, now known or later developed. This includes permanent storage in public notice archives and compliance databases.

You acknowledge and agree that iCreateAds and the newspaper(s) have full rights to the notices/ads created or managed through the platform. You waive any right to royalties, residuals, or additional compensation beyond the fees you pay for publication. You further represent that you have all rights necessary to submit the content and that it complies with applicable laws and third-party rights. iCreateAds is not a law firm and does not provide legal advice.

5. Acceptable Use

• No unlawful, infringing, deceptive, or defamatory content
• No attempts to interfere with or disrupt services
• No scraping, reverse engineering, or unauthorized access

6. Service Availability

We do not guarantee uninterrupted availability. Newspapers may impose deadlines, format, and acceptance criteria. You are solely responsible for meeting legal and timing requirements of publication.

7. Previews, Beta & Modifications

Beta features are provided “AS IS,” may change or end at any time, and may be less reliable. We may modify or discontinue services at any time.

8. Intellectual Property

The iCreateAds platform, software, and content (excluding user-submitted ads/notices) are owned by iCreateAds and protected by law. No rights are granted except as expressly provided.

9. DMCA & Takedowns

To submit a copyright notice, email support@icreateads.com with subject “DMCA Notice” and the required legal details. We may remove or disable content and terminate repeat infringers.

10. Warranties & Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT SUBMISSIONS WILL BE ACCEPTED OR PUBLISHED BY THIRD-PARTY NEWSPAPERS OR THAT DEADLINES WILL BE MET.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, iCREATEADS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THAT PERIOD.

12. Indemnification

You agree to indemnify and hold harmless iCreateAds and its partners from claims, damages, liabilities, or expenses arising from your content, use of the services, or violation of these Terms.

13. Export & Sanctions Compliance

You agree to comply with all applicable export control and sanctions laws.

14. Force Majeure

We are not liable for failures caused by events beyond our control (e.g., natural disasters, internet outages, cyberattacks, labor disputes, acts of government).

15. Arbitration & Class Action Waiver

All disputes will be resolved by binding individual arbitration under the Federal Arbitration Act. Class actions and collective proceedings are not permitted. Either party may seek injunctive relief in court for intellectual property misuse or unauthorized access.

16. Governing Law & Venue

These Terms are governed by the laws of the State of New York, excluding conflicts rules. Subject to arbitration, exclusive venue lies in courts located in New York, NY.

17. Changes

We may update these Terms. Material changes will be announced on our site or by email. Continued use means acceptance of updates.

18. Miscellaneous

Entire Agreement: These Terms are the full agreement. Assignment: You may not assign without consent; we may assign freely. Severability: Invalid provisions are modified to be enforceable; others remain effective. Waiver: No waiver is valid unless in writing.
